Legal matters / theft of Capone I :.Recently we have been faced with the theft, in broad daylight, of our beloved stallion friend Capone I. Here is a full set of the official press releases and background information on the case, as it has progressed:α Original press release announcing the disappearance of Capone. α Press release announcing the location of Capone, and the identity of the perpetrator. α Full copy of the Exitpoint Stallions Limited civil lawsuit against Defendant Corinne Super. α Full copy of sworn affidavit filed by Ms. Super, disavowing any ownership interest in Capone. α Our legal team has continued to make short work of efforts Ms. Super has made to delay the inevitable return of Capone to his rightful owners via our civil litigation against her. With a dwindling list of obstacles she can place in the path of his safe return, we are more and more confident every day that he will be home soon. Our many thanks to everyone who has helped keep the pressure on - we are almost there! ' α We have chosen to make public a full, signed, sworn, notarized, copy of the affidavit in support of summary judgment we filed with the BC Supreme Court last week. It contains 103 pages of original, certified copies of all documentation relating to Capone's ownership since his purchase in 1998. This is the full extent of our case with regards to the return of Capone - we need no more discovery, nor exhibits, nor depositions, nor research. We are ready for trial - now. There are no substantive points of fact or law being contested and we are optimistic that the courts will resolve this matter once and for all in an expeditious manner. α Here is a copy of the No Trespassing sign posted on the doors to the barn, and on the stall Capone was stolen from - hard to see how there was any confusion about his ownership. No effort was made to contact anybody to inform them of the removal of Capone, and it took authorities almost four days to locate him definitively. α We received confirmation from Equine Canada of the date when Capone`s FEI passport was illegally transferred out of his owner`s name and into the name of the person who has tried to steal him. Equine Canada further explicitly rejects her claim that the fraudulently-transferred passport `proves` she owns Capone. There is now no documentation at all supporting Super`s claim to have suddenly become the owner of Capone in 2005 - with no record of a purchase of him from his longtime owners. Now it is simply a question of enforcing proper orders via the BC Supreme Court to return Capone, and to do our best to assist law enforcement in holding her (and several accomplices who investigators have uncovered) accountable for her crime. We pray she does not harm Capone before he is home safe. α We have announced the terms of our reward offer for the safe return of Capone to his home. There is $5,000 offered, and details are available in the poster that has been circulated throughout BC and Washington State. Already we have been contacted by several people with offers to assist, and we are working to ensure this is accomplished with the safety of Capone as our highest priority. Several people have also approached us to warn us that Ms. Super has some very unsavory connections and a history that is not well-known. Needless to say, we are even more dedicated to ensuring that Capone is removed from this bad situation as soon as is safely practical. α Despite the efforts of Ms. Super to censor news about her theft of Capone, many newspapers and magazines have continued to follow the case and report on our progress towards his safe recovery. A Canadian paper, the Chilliwack Times, has done some good investigative reporting on Ms. Super and her past - here is a recent story about her bizarre, hours-long endangerment of Capone (in a rusty trailer with bald tires and no insurance) as she was observed fleeing around the Lower Mainland. Similarly, The Horse magazine has published this article about the recovery of Capone (the email address for their news editor, Erin Ryder, is: eryder@thehorse.com, for those who wish to email and thank her for following this case factually and accurately). α Over the weekend The Globe and Mail ran this investigative reporting story on the theft of Capone. I have a few minor qualms (never would I refer to Capone as "it," for example) but overall they did a good job of covering the salient points and did not fall for any of the Corinne Super nonsense. Interesting to see that her "story" has changed again and this time it is that I personally "gave her the horse in 2005 to pay a $150,000 debt arising from boarding Capone 1 and several other horses and dogs." She needs to do a better job of creating these stories - this one makes no sense at all! Why would I "give" her a horse I do not own, for less than 1/10th his lowball value, for boarding bills (one hundred and fifty thousand dollars in board?!?) that did not even exist yet according to her story itself? After all, Ms. Super fraudulently transferred the listed owner in his FEI Passport in May of 2005 - less than 60 days after I left the stallions in her care. It is truly pathetic and sad - no wonder she hides from the press, the public, and the world. Kudos to the G&M for seeing the truth behind her sad fantasies. α A good example of that kind of slanderous garbage that has been the only way Ms. Super appears to have to deflect focus from her own criminal actions (and criminal past) is an email sent recently by Karin Hunt of Shadysprings Farms in Oregon (one recipient of it was disgusted and provided a copy to use in any legal actions). Ms. Hunt has bred several mares to Capone over the years, and we provided in the past for her several discounted breedings when she could not afford the normal booking fees - she now has a number of outstanding Capone babies on her farm. Nevertheless, this is the kind of childish rumors Ms. Hunt passes about us in an attempt to censor coverage of the theft of Capone and the process of his recovery. It seems > someone should check into the facts before printing these types of > stories. Did you receive this information from Doug Spink? This is a > legal matter between two people disputing ownership. This is not a > stolen horse. The sheriff knows where the horse is. Now you have > offered a reward in the article for anyone willing to try and get the > horse back legally? That invites someone to use illegal tactics to > get $5,000. Before printing this article did you call the sheriff's > department to clarify whether the article was correct? I have always > enjoyed your newsletter. It concerns me that you may become another > victim of Mr. Spinks spreading rumors. > > I do not want you to reprint this letter but just that you should > verify information if you received it from him. People that he has > had disputes with end up having problems with their websites being > hacked and sent to porn sites, etc. No one can prove who has done > this but the timing always coincides. For this reason I appreciate > that you keep my letter to you confidential. I want fairness for all > parties involved. > > I have had several Capone offspring born at my farm and he is a > wonderful stallion. It is to bad that everything about this great > stallion is now gossip. > > You can reach me through emails or can be reached at 503 621-6932. I > have also contacted the sheriff when the horse first came up missing > and others as well. Thanks, Karin, for "secretly" spreading such tripe. I hope you are proud of your actions. Look out though - I might use my magical hacking powers to take over your website. No wonder you do not want anyone to know you are saying this stuff - not only is it slander, it is also idiotic. I am sure you will agree that it is only "fair" that your words be seen by everyone, so that your gossip can be exposed for what it is: lies. Has Ms. Super paid you off with the promise of free breedings to the stallion she stole? Maybe we will learn the truth during the prosecution of the theft. Until then, you should be ashamed of your actions.
